Terms of Service

Terms of Service

Version 1.0. In effect from .

These terms are the agreement between you and Coparia Labs LLC (“we”, “us”), a California limited liability company and the company that makes RideZone, for the use of the RideZone apps for iPhone, Android and Apple Watch and the websites at ridezone.app and app.ridezone.app. By creating an account or using RideZone you accept them. If you do not accept them, do not use RideZone.

We have tried to write this in plain language. Plain does not mean weaker: everything here is meant to be read literally. How we handle your family’s information is in the Privacy Policy, which forms part of these terms.

What RideZone is

RideZone helps parents agree with their kids on where and when they can ride. A parent draws zones on a map and sets riding times and rules. While the rider has a ride on, their Apple Watch warns them before they leave a zone, and their parents get an alert if they do.

RideZone is not a safety device. Read the limits section before you rely on it for anything.

Who may use it

You must be 18 or older and legally able to enter a contract to have an account. Accounts are for parents, legal guardians and the adults they invite.

A rider does not get an account. A parent creates a rider profile and pairs the rider’s watch. You may create a rider profile only for a child who is yours, or for whom you are a legal guardian, and by creating it you agree, as that child’s parent or guardian, to RideZone collecting the child’s information as the Privacy Policy describes. You are responsible for how the rider’s watch is used.

You are responsible for what happens under your account. Keep your sign-in details to yourself and tell us at security@ridezone.app if you think someone else has access. One account is one person; do not share it.

Families, guardians and the riding agreement

When you create or join a family, the other parents in it see everything about its riders. A guardian you invite, such as a grandparent, sitter or coach, sees the live map, rides and alerts for the riders you give them, and changes nothing. Remove a guardian, or another parent, and their access ends at once. A family always keeps at least one parent.

The riding agreement is between your family and your rider. RideZone stores it and shows it to your family and your rider. It never enforces a rule or a consequence, and we take no part in how your family uses it.

The rider turns it on

Location is collected only while a ride is on, and a ride is on only while the rider’s watch says so on screen. The rider can end a ride at any time, and their family is told when they do, unless someone has turned that alert off for themselves.

Do not use RideZone, or try to use it, to follow anyone without their knowledge. Do not try to hide a ride from the rider, start one from afar, or pair a watch to someone who is not your rider.

Your content

What you enter stays yours: zones, rules, the agreement and its signatures, and your profile photo. You give us permission to store it, process it and show it to the people in your family who are allowed to see it, which is what makes RideZone work. That permission ends when the content is deleted, except for what the Privacy Policy says we keep, such as backups and the signatures on an agreement that was signed.

You are responsible for having the right to enter what you enter.

Our content and our name

RideZone itself belongs to Coparia Labs LLC: the software, the design, the words on these pages and the logo. Using it gives you a personal, non-exclusive, non-transferable right to use it for your own family, for as long as your account is open. It does not transfer ownership of any of it to you, and it is not a license to build something else out of it.

You are welcome to refer to RideZone by name, to link to it, and to say that you use it. Please do not use the name or the logo as your own, or in a way that suggests we endorse something we do not. Nothing here stops you from describing RideZone fairly, including in a review or a complaint.

What you may not do

Do not use RideZone to:

  • follow, monitor or locate anyone other than a rider you are a parent of or were given access to, or anyone without their knowledge;
  • harass, threaten, stalk or abuse anyone;
  • break the law, or breach a court order, including one about who may see a child’s location;
  • impersonate anyone, or misrepresent your relationship to a child;
  • attack the service, probe it without permission, or try to reach data that is not yours;
  • scrape it, resell it, or run it on someone else’s behalf as a service of your own.

We can suspend or close an account that does any of these. Where it is safe and lawful to do so we will say why.

The limits of what this is

This matters more here than in most software, so it gets its own section.

  • Not a safety device, and no substitute for supervision. RideZone does not prevent a crash, an injury or a rider going somewhere they should not. You decide whether your child is ready to ride where they ride, and RideZone does not change that.
  • Locations can be wrong. A watch’s position can be off by many feet, more under trees, between buildings or with a weak signal. A warning can come late, early or not at all, and a zone line on the map is only as accurate as where you drew it.
  • Alerts can be late or never arrive. An alert depends on the rider’s watch having a ride on, charge and a signal, on your phone and its settings, and on Apple, Google and the other services that carry it. If the watch is off, out of charge, out of signal or left at home, nobody is told.
  • Riding is the rider’s responsibility, and yours. Riders must follow traffic laws and the rules for their bike or e-bike where they ride, and wear a helmet. A rider should never look at their watch in traffic, which is why every warning is felt on the wrist, not only shown on the screen.
  • Not an emergency service. If a child is missing or in danger, call 911, or your local emergency number. Do not wait for, or rely on, an alert from RideZone.

Availability

We want RideZone up, and we work at keeping it up. We do not promise that it will be available without interruption or free of faults. Maintenance happens, and providers fail. The current status is at ridezone.app/status.

Price

RideZone is free to use today. If we introduce a paid plan, we will tell you before it applies to your family, and you will not be charged without agreeing to a price first. There are no purchases on a rider’s watch.

Apple and Google

If you got RideZone from the App Store, your use of the app is also governed by Apple’s Licensed Application End User License Agreement. Where that agreement and these terms differ about the app itself, Apple’s agreement takes precedence for the app. These terms are between you and Coparia Labs LLC, not Apple or Google, and Coparia Labs LLC is responsible for RideZone and its content. Apple and Google have no duty to maintain or support it, and Coparia Labs LLC, not Apple, handles any claim about RideZone, including product, legal compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a US embargo and not on a US list of prohibited or restricted parties.

Maps, place search, alerts and Sign in with Apple or Google are provided by Apple, Google and the other services named in the Privacy Policy, under their own terms. A ride saved to Apple Health stays in the rider’s Health on their watch and in their iCloud account, under Apple’s terms.

Ending it

You can delete your account at any time, in the app or at app.ridezone.app, under Profile, Delete account. What happens to your family’s information when you do is in the Privacy Policy. A parent can also remove a rider, or unpair their watch, at any time.

We can suspend or end your access if you break these terms, if we are required to, or if we stop offering RideZone. If we shut it down we will give reasonable notice first.

Our liability

RideZone is provided “as is”. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, for lost data, or for any harm that a warning or an alert that was late, wrong or missing did not prevent. Our total liability to you for all claims is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some places do not allow these exclusions, and where that is so, they do not apply to you.

Indemnity

If someone brings a claim against us because of what you did with RideZone, or because of content you entered, you agree to cover our reasonable costs in defending it, except to the extent the claim arises from our own wrongdoing.

How we tell you

When these terms say we will tell you something, we will email the address on your account, or show it in the app.

Changes to these terms

We can change these terms. When a change is material we will raise the version number at the top of this page and tell you before it takes effect, and continuing to use RideZone after that means you accept the new version. If you do not, delete your account.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not resolved between us first.

Nothing here takes away a right you have under the law of the place you live that cannot be waived by agreement.

The rest

If a part of these terms cannot be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about RideZone. Not enforcing a term is not a waiver of it. We may transfer these terms to a company that takes over RideZone; you may not transfer them. The sections on liability, indemnity and governing law still apply after your account is closed.
